On Sept. 8, the DOL's Employee Benefits Security Administration (EBSA) published new interim guidelines for enforcing treatment limitations under the original 2008 Mental Health Parity and Addiction Equity Act. The Trump administration has signaled intent to create a new proposed rule entirely, but this interim guideline aims to clarify enforcement of the nonquantitative treatment limitation (NQTL) requirements in the meantime. The guidelines highlight three areas in particular: Insurance policies that exclude certain mental health or substance use treatments; prior authorization and medical necessity reviews that make it harder to access behavioral health services; and health plan provider networks that lack enough mental health and addiction treatment providers or reimburse them differently than medical providers.
